Why are so many pictures censored? On July 8th 2022 I received an e-mail from Sabine Lipovetsky, associate attorney at Harlay Associates, a law firm contracted by the city of Paris, informing me that the «SETE» (Société d’Exploitation de la Tour Eiffel) holds the copyright for the various lighting schemes on the Eiffel Tower. “Indeed, the lighting of the monument, as well as the sparkling lights and the tower’s rotating spotlight, constitute original and creative works of their authors contributing to the nighttime beauty of the Eiffel Tower.”
“Consequently, the fact of representing the image of the Eiffel Tower illuminated in golden light at night, with its beacon on products, without the authorization of SETE and without paying the corresponding royalties, infringes on the rights of the City of Paris and of SETE and constitutes acts of counterfeiting.” 😂 I make counterfeits of the Eiffel Tower? Yeah, right!
Ms. Lipovetsky’s message carries on asking me to specify how many “products” I’m selling of the Eiffel Tower, for how long and how much money I’ve made from the tower, so they can calculate how much I owe. I started my web site on February 15th 2000 and since then I’ve made perhaps $700 from my pictures of the Eiffel Tower, which is to say less than $35 per year on average, and actually no more than two-thirds of those photos were taken at night. Beyond that, trying to make pictures of the Eiffel Tower at night illegal is like trying to outlaw breathing: People will do it anyways; go figure…
